Questions

Which states presume retaliation when a landlord acts soon after a complaint?

In our verified data, 21 of 51 jurisdictions set a time window after the tenant's complaint: 5 use 90 days, 12 use 6 months and 4 use 1 year. Inside the window the statute treats the timing as a sign of retaliation, often as a rebuttable presumption.

Which states have a landlord retaliation statute?

42 of 51 jurisdictions in our verified data have a retaliation statute. 21 of them ban retaliation but set no fixed time window, and 9 have no general retaliation statute in our data.

How does this checker count the window?

It counts from the date of the tenant's complaint or protected act to the date of the landlord's action. A 6-month or 1-year window is counted in calendar months; where a statute's text says a number of days (California: 180 days) we count those days.

What if my landlord acted outside the window?

You can still claim retaliation, but you would need other evidence of motive. Where a state sets no fixed window, timing is evidence rather than a presumption.

Do exceptions apply to retaliation rules?

Yes. State statutes typically list exceptions, for example unpaid rent or a lease breach by the tenant. The exact rule and citation for each state are shown with the result and on each state page.
